Trump Flouts Law Again with Department of Education Executive Order

WASHINGTON, D.C., March 20, 2025 – Today the Trump administration issued an executive order calling for the dismantling of the Department of Education even though the department was created by Congress and can only be removed by an act of Congress.
Alliance for Justice Interim Co-President Keith Thirion issued the following statement:
“How many more examples do we need that Trump believes the Constitution just doesn’t apply to him? By the letter of the law, he does not have the power to tear down an entire department — period. But Trump doesn’t care, even after so many of his illegal actions have been stopped by the courts. He’s going to keep trying because he believes himself to be a king, and the courts are our last check on his power. His effort to eliminate the Department of Education will no doubt wind up in court as well, but low-income students, students with disabilities, student loan borrowers, and so many more will be harmed in the meantime.
“Our democracy is as fragile as ever. We must take every step possible to ensure the courts are empowered to uphold the law and the very heart of the Constitution: the separation of powers. With four Supreme Court justices seemingly ready to let Trump run away with our country, we must be steadfast in honoring the role of the judiciary and protect it from the corruption of Trump loyalists. This also means the Senate must scrutinize Trump’s forthcoming judicial nominees and block any that won’t stand up to his flagrant abuses of power. If the courts fail to hold Trump accountable for his unlawful acts, it could be the end of the great American experiment as we know it.”
