Crain attracted opposition from pro-choice community in his Supreme Court dissent in June Medical Services LLC v. Landry. The Court had issued a temporary injunction that allowed abortion providers to temporarily operate after the U.S. Supreme Court returned to the states the determination of who could terminate pregnancies and when.
Crain’s comments in his dissent “can only be implied as supporting the extreme legal doctrine of fetal personhood,” according to the Alliance for Justice, a left-leaning judicial advocacy group based in Washington.
