Progressive groups including the Alliance for Justice opposed both nominations but were especially harsh in their criticism of conservative views shared in the past by Bragdon.

“Bragdon’s writings and proposals paint a picture of a nominee who would rather impose rigid and religious morals and allow harsh and potentially unjust punishments to prevail over guaranteeing fairness, acknowledging well-accepted data and following the law,” Alliance for Justice President Rachel Rossi wrote in a letter to Republican Senate Judiciary Committee Chairman Charles Grassley and the panel’s top Democrat, Richard Durbin. “This perspective remains fundamentally at odds with the role of a federal judge and threatens to erode constitutional protections that millions in a free and fair democracy rely upon.”
