Biden nominated Pitts last September to fill the vacancy created by his appointment of U.S, District Judge Lucy Koh to the Ninth U.S. Circuit Court of Appeals, but the Senate did not vote on his confirmation. The president renominated Pitts in January and this time he won approval in close committee and floor votes in the Democratic-majority Senate. The opposition was related to Pitts’ advocacy for labor unions, said the Alliance for Justice, a liberal group that supported the nomination.
