Rakim H.D. Brooks, president of the Alliance for Justice, said in an interview that filling circuit court seats should continue to be a priority, adding that Democrats should also focus on filling seats in states with two Democratic senators where approval from home-state senators won’t be an issue. Trial court nominees for states with Republican lawmakers face a tougher path to confirmation because of the blue-slip rule requiring home-state senators’ approval for district court picks.

“I think it’s essential that Democrats fill all of the seats that are available to them so that those aren’t surrendered to Republicans,” Brooks said. “Democrats and the White House are going to use every hour that they have to try and fill every seat that they can.”
